FIVE ALIVE® FEEL ALIVE® AT THE KING OF THE AIR CONTEST Official Rules NO PURCHASE REQUIRED TO ENTER OR WIN Eligibility: FIVE ALIVE® on-line contest (the “Contest”) is open only to residents of Canada (excluding Quebec), who are thirteen (13) years of age or older at the time of entry. Employees, officers, directors, representatives, and agents of Coca-Cola Ltd., authorized bottlers and distributors of Coca-Cola® products, its respective advertising and promotional agencies, and /or any of the respective affiliates, related entities, successors and/or assigns of any of the above, and SBC MEDIA, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Submissions through groups and/or charities will not be accepted. The Contest is subject to all applicable federal, state, provincial, territorial, municipal and local laws and regulations and is void in Quebec and where prohibited by law. Agreement to Official Rules: By participating in the Contest, entrant warrants that he/she fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrator, which are final and binding in all matters related to the Contest. Entry Periods: The Contest begins August 15, 2005 at 12:00:01 a.m. EDT, and ends at 11:59:59 p.m. EDT, September 25, 2005 (the “Promotion Period”). How to Enter: During the Promotion Period, visit www.sbckiteboard.com and follow the online instructions to complete and submit an official online entry form. You will automatically receive one (1) entry into the Contest. Limit: One (1) Contest entry per day, per person, per email address, per household address during the Promotion Period. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant’s entries and that participant may be disqualified. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, Contest entry services) will void all entries by that entrant. Drawing: Administrator is an independent judging organization whose decisions as to the selection of the potential winners are final and binding. On September 26, 2005 at approximately 12:00pm EDT at 2255B Queen Street E., Toronto, ON M4E 1G3 Administrator will select one (1) potential winner in a random draw from all on-line entries received on or before 11:59:59 p.m. EDT, September 25, 2005 (the “Contest Close Date”). Potential winner will be contacted by telephone at the number listed on the entrant’s online entry form by no later than September 26, 2005. The odds of winning a prize depend on the total number of eligible on-line entries received by the Contest Close Date. Requirements of Potential Winners: Prize must be accepted as awarded. Potential winners must continue to comply with the Official Rules and winning is contingent upon fulfilling all requirements. Potential winner (or parent/legal guardian if potential winner is a minor in his/her jurisdiction of residence) will be required to sign and return to Sponsor, within fourteen (14) days of the date notice or attempted notice is sent, a Declaration of Compliance (except if prohibited) in order to claim their prize and fulfill any such other requirements as determined by Administrator. If a potential winner fails to sign and return the Declaration of Compliance within the required time period the potential winner forfeits the prize. Potential winner’s guests (or their parent/legal guardian if guest is a minor in his/her jurisdiction of residence) will be required to sign a declaration and release, or other documentation, as required by Administrator (except if prohibited). Guests failing to sign and return such documentation will be prohibited from using or participating in the Prize. Potential winner agrees to be fully responsible for all guests in all aspects related to the guests’ use and participation in the Prize. All potential winners are required to correctly answer a time-limited skill testing question without any assistance in order to be eligible to receive the Prize. If the question is answered incorrectly, the Prize will be forfeited. In the event that a potential winner is disqualified for any reason, Administrator will select an alternate winner in a random drawing from among all remaining eligible entries, up to three alternates. Approximate total retail value of the Prize is $5,000 (actual value will depend upon the city from which winner and guest depart. Winner and winner’s guest are solely responsible for all other costs not specifically mentioned as part of the Prize including, but not limited to: other ground transportation, taxes, transfers, and travel insurance, spending money, tips, meals and other travel and hotel charges. Winner and winner’s guest are solely responsible for obtaining their own travel documents, such as a passport for international travel, as may be required, in advance of the departure date, including the ability to enter and exit from USA. Trip must be taken on the dates specified above. In the event winner and/or winner’s guest cannot travel within the specified dates of the determined event or are unable to attend King of the Air 2005 for whatever reason, any unused portion of the Prize will be forfeited. In the event that the winner is a minor, the minor winner’s parent or legal guardian must sign the release of liability and acknowledgement form on behalf of the minor winner and the minor winner’s guest must be an adult. If the adult is not the parent or legal guardian of the minor winner, the parent or legal guardian of the winner must consent to the adult accompanying the minor winner. In the event of unavailability of any component of the Prize for whatever reason, Coca-Cola Ltd. reserves the right to substitute any of the Prize with prize(s) of equal or greater value. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Except where prohibited, participation in the Contest constitutes entrant’s consent for the Sponsor and the Sponsor’s designees to use entrant’s name, likeness and editorial and pictorial coverage of the events as a ‘Guest Journalist’ for promotional purposes related to this contest in any media without further consideration General Conditions: In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but, not limited to, fraud, virus or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize in a random drawing from among all eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserve the right to seek damages from any such person to the fullest extent permitted by law. A potential winner may be required to show proof of being the authorized account holder. Release and Limitations of Liability: Except where prohibited, by participating in the Contest, entrants agree to release and hold harmless Coca-Cola Ltd., Coca-Cola® Bottlers, authorized bottlers and distributors of Coca-Cola® products, its respective advertising and promotional agencies, and SBC MEDIA /or any of the respective affiliates, related entities, successors and/or assigns of any of the above (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Contest or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest and in no event shall the Released Parties be liable for legal fees.
